Pennsylvania Agency Must Pay $2.3 Million In Back Wages For Overtime Violations

Another home health wage case will result in millions in back wages paid to workers.

Affectionate Home Health Care Services in Lansdowne, Penn., and owners Ashford Sonii and Habibatu Dumbar must pay more than $2.3 million in back wages and liquidated damages to 398 home healthcare workers following a federal court judgment, the Department of Labor says in a release.

The company paid straight time for overtime hours worked, paid an arbitrary rate less than time-and-a-half for hours over 40 in a workweek, or used a combination of the two illegal pay practices, the DOL says. It also did not separate straight-time hours worked from overtime hours and failed to record the proper hourly rates in overtime work weeks accurately, the DOL adds.

“Hardworking healthcare workers will choose to work for employers who value them, pay them full wages and respect their rights,” Principal Deputy Wage and Hour Administrator Jessica Looman says in the release. “Employers who comply with labor law and appreciate the dignity of work will have a clear advantage when it comes to recruiting and retaining workers.”
